The short answer

The TR1 is HM Land Registry's deed for transferring the whole of a registered title. It has 12 panels: the title number, property, date, the people transferring and receiving, their address for service, the price, the title guarantee, how joint buyers hold, any extra covenants, and the signatures. It is signed as a deed and sent to HM Land Registry with form AP1.

Signing and witnessing

The TR1 is a deed. Each individual signs in the presence of a witness, who must actually be there when it is signed and then signs and adds their details. One witness can attest several signatures, but must complete the witness details under each one. A party to the deed can't witness another party's signature (Practice Guide 8).

A company can sign by two authorised signatories (a director and the secretary must be two different people), or by a single director whose signature is witnessed. Attorneys and other cases use the wording in HM Land Registry's Practice Guide 8.

Electronic signing is possible only through a signing platform under Practice Guide 82, with a regulated conveyancer setting up and controlling the process and certifying it. The witness confirms with a one-time code sent to their phone.

Common reasons HM Land Registry sends it back

These are from HM Land Registry's own list of reasons for requisitions (Practice Guide 50):

  • A signature not witnessed, or no evidence of authority to sign (for example a power of attorney not sent) (PG50).
  • Names on the transfer that don't match the register, or each other (PG50).
  • Joint buyers where the application doesn't say whether a Form A restriction is needed, or says both (PG50).
  • Clerical details in the deed that are incomplete or wrong, or a poor-quality copy (PG50).
  • No SDLT5 certificate where one is needed (PG50).

The next step is the AP1 application, and on a purchase the SDLT return must be filed within 14 days of completion (GOV.UK).

Questions

What is a TR1 form?
HM Land Registry's form for transferring the whole of one or more registered titles, used for a sale, a gift or a transfer into or out of joint names. It is signed as a deed and sent to HM Land Registry with an AP1 application to update the register.
TR1 or TP1?
TR1 is for the whole of a registered title. To transfer part of a title, such as part of a garden or one plot from a larger title, HM Land Registry says to use form TP1.
Who signs the TR1?
All the transferors must sign it as a deed. The transferees must also sign if the declaration of trust (panel 10) or additional provisions (panel 11) are completed.
Who can witness a signature on a TR1?
An independent person, preferably someone who knows the signer, who is actually present when the deed is signed. A party to the transfer can't witness another party's signature. HM Land Registry says a spouse, civil partner or partner who isn't a party can witness, but it is best avoided.
What happens if panel 10 isn't completed for joint buyers?
If neither panel 10 nor a form JO is completed, HM Land Registry enters a Form A restriction on the register by default, the restriction used where the owners may hold as tenants in common.
Can a TR1 be signed electronically?
Yes, but only in the ways HM Land Registry accepts: its Practice Guide 82 allows transfers to be signed through a signing platform with the process run and certified by a conveyancer. A simple typed or pasted signature is not accepted for a transfer.
What is sent with the TR1?
Form AP1 if the property is registered (FR1 if it isn't), the fee, evidence of identity where required and, if Stamp Duty Land Tax is payable, the SDLT5 certificate.
